CC&Rs

Covenants, Conditions & Restrictions – Real Estate Investing Glossary

Definition

CC&Rs (Covenants, Conditions & Restrictions) are recorded governing documents for a subdivision, condominium, or planned community. They establish legally binding rules regarding property use, architectural standards, and the authority of the homeowners association (HOA).

What CC&Rs Typically Cover

Legal Status

CC&Rs are recorded with the county and typically “run with the land,” meaning they bind current and future owners. Violations can result in fines, liens, or legal enforcement actions by the HOA.

Investor Implications

Example

An investor purchases a condo unit intending to lease it short-term. The CC&Rs require a minimum 12-month lease and cap total rentals at 20% of units. The investor must comply or risk penalties from the HOA.
