Change of Use

Real Estate Investing Glossary – Malone Global University

Definition

A change of use occurs when a property is converted from one legally permitted function to another. For example, converting a retail storefront into apartments, an office building into a hotel, or a warehouse into creative office space may require a formal change-of-use approval.

Because building codes and zoning rules vary by property type, a change of use often requires permits, inspections, and regulatory approval before the new use can legally operate.

Common Examples

Why It Matters for Investors

Change-of-use strategies are a common value-add investment approach. Investors may acquire an underperforming property and reposition it into a more profitable use based on market demand.

Regulatory Considerations

Change-of-use projects often trigger additional regulatory review because different property types must meet different building code requirements.

Example

An investor purchases an aging downtown office building that struggles to attract tenants. Local zoning allows residential use, so the investor redevelops the property into apartments. After renovation and regulatory approval, the building generates significantly higher rents than it did as office space.
