Notice to Enter

Real Estate Investing Glossary – Malone Global University

Definition

A notice to enter is a written (or otherwise documented) notice a landlord provides to a tenant stating the landlord’s intent to enter the rental unit for a lawful purpose—such as repairs, inspections, or showings. Most jurisdictions require advance notice except in emergencies.

Why Notices Matter

A proper notice to enter supports a landlord’s right of entry while also respecting tenant privacy and quiet enjoyment. Operationally, it reduces disputes, improves cooperation, and creates a clear record if an entry is later challenged.

Common Reasons to Issue a Notice to Enter

What a Strong Notice Usually Includes

Notice Period and “Reasonable Time”

The required notice period varies by state and city, and the lease may add additional requirements. Outside of true emergencies, best practice is to provide notice far enough in advance that the resident can prepare. Entries should occur at reasonable times and be limited to the stated purpose.

Emergencies

In genuine emergencies (active leaks, smoke/fire, suspected gas issues, immediate safety hazards), landlords may be allowed to enter without advance notice. Even then, operators should document what happened and notify the resident as soon as practical.
